
A courtroom in Nairobi was thrown into shock on Wednesday when a suspect in the murder case of Kasipul MP Charles Were allegedly threatened to kill a state prosecutor during a court session.
Ebel Ochieng Kalo, a senior official of the United Democratic Alliance (UDA) and a board member of the Lake Basin Development Authority (LBDA), is one of the key suspects in the high-profile murder. Kalo is currently in custody as investigations continue into the fatal shooting of MP Were, which occurred on April 30, 2025, near City Mortuary in Nairobi.
The incident unfolded at the Milimani Law Courts, where Kalo appeared before Justice Diana Kavedza. During the hearing, he reportedly turned toward prosecutor Allen Mulama from the Office of the Director of Public Prosecutions (ODPP) and issued a chilling threat in Swahili: “Huyu tutamuua,” which translates to “We will kill him.” This came shortly after Mulama opposed Kalo’s request to be released on bond.
The threat caused immediate alarm in the courtroom. Prosecutor Mulama walked out of the proceedings, prompting Justice Kavedza to act quickly. She ordered enhanced security in court and denied bail for all three suspects in the case. The judge also directed that Kalo be taken to Mathari Hospital for a mental health evaluation. The third suspect was ordered to be held in isolation at Nairobi Remand Prison until medical assessments are completed.
The case is set to be mentioned again on June 17, with the prosecution calling for urgent and firm action following the courtroom threat.
In a related hearing held virtually by Justice Margaret Muigai, two other suspects—Isaack Kuria and Allan Omondi Ogolla—were ordered to undergo mental evaluation before they are officially charged with murder. They will remain in custody at Kamiti Maximum Security Prison and have been assigned legal representation.
MP Charles Were was gunned down in broad daylight at close range by an assailant on a motorbike. Police investigations have linked the killing to a wider conspiracy that allegedly includes Were’s own driver and bodyguard.
The case has drawn national attention due to the political affiliations of the suspects and the dramatic developments in court.
